End User License Agreement

Finish USER LICENSE AGREEMENT

This Cease User License Agreement (hereafter "the Understanding")

is a legal agreement between you and EIZO CORPORATION

(futurity "the Company") of the software production (futurity

"the Software") specified in Provision one of the Understanding.

By installing the Software, yous are agreeing to be bound by

these terms and conditions in the Agreement. If you do non

concur with these terms and conditions, please do not install,

copy or apply the Software.

1. DEFINITION: The Software in the Agreement includes

a program or a data file fabricated and provided past the

Company, and may include associated media, printed

materials and any online or electronic documentation,

all of which are provided by the Company.

two. GRANT OF LICENSE: The Company grants to y'all a

non-exclusive right to use the Software on an unlimited

number of personal computers provided that you remain

responsible for the compliance of each user with the

terms and weather hereof. The Company reserves

all rights non expressly granted under the Agreement.

3. Ownership OF INTELLECTUAL Property:

The Company retains all rights, title and ownership to

the Software,and the copyright and whatsoever other intellectual

properties apropos the Software.

4. Re-create RESTRICTIONS: You may not re-create the Software,

except that y'all may make a unmarried copy of the Software

for your own backup or archival purposes only. You

may non utilize the backup copy for any purpose other than

reinstalling the Software in the figurer mentioned

Yin Provision two. You are held legally responsible for whatever

copying or copyright infringement which is caused or

encouraged by your failure to abide by the terms of

this brake.

v. TRANSFER RESTRICTIONS: You may not allow the

Software to be used by anyone else through transfer,

rent, lease or whatsoever other ways, whether with bounty

or not, without the prior written consent of the Company.

RESTRICTIONS: You may non opposite engineer,

disassemble, decompile, modify, suit, translate,

or create derivative works based on the Software, delete

or modify the intellectual belongings mark in the Software

without the prior written consent of the Company.

7. TERMINATION: This Agreement is effective until terminated.

The Understanding will finish automatically, without observe

from the Company and become null and void if y'all fail to

comply with whatever provisions of the Agreement. Upon

termination, the Visitor may request you to destroy the

Software and all copies of the Software. In add-on to,

or instead of the request mentioned in a higher place, the Visitor may

request you to destroy the Software and all request mentioned

higher up, the Company may claim damages confronting you.

viii. Express WARRANTY: The Company disclaims all

warranties, express, unsaid, statutory or otherwise, including

without limitation, the implied warranties of merchantability,

fitness for a detail purpose, and nonexistence of virus

with respect to the Software.

9. LIMITATION OF LIABILITY: In no event, shall the Company

be liable for any incidental, indirect, special or damages

consequential damages (including, without limitation,

amercement for loss of business profit, business concern break,

loss of business organization information, or any other pecuniary loss)

arising out of the use or disability to utilise the Software or in

any connection with the Software, except that such damages

are acquired by the Visitor's intention or gross negligence.

ten. GOVERNING Constabulary AND JURISDICTION:

(1) This Agreement shall be construed in accordance with

the laws of Nihon.

(2) Any legal action to enforce or interpret the terms of

this Understanding shall be brought exclusively in the

Tokyo District Court,Tokyo, Japan.
